Tobacco Use Prevention
Senate Bill 793: California’s Flavored Tobacco Sales Law - Effective December 21, 2022
Senate Bill 793 prohibits the retail sale of most flavored tobacco products in California. The following tobacco products are now prohibited:

Flavored e-cigarettes or vapes, e-juice, pods, or cartridges,

Menthol cigarettes,

Flavored little cigars and cigarillos,

Flavored loose leaf roll-your-own tobacco,
-
Flavored smokeless tobacco products,
-
Flavored Tobacco Rolling Papers, and
-
Tobacco product flavor enhancers.
Three flavored product categories can be sold under SB-793:
- Flavored hookah and shisha: Must be sold by a licensed hookah tobacco retailer that limits entry to those aged 21 and over; does not apply to electronic hookah products
- Flavored pipe tobacco: Applies to loose leaf tobacco, defined as “cut or shredded pipe tobacco, usually sold in pouches,” but not any tobacco product suitable for making cigarettes, including roll-your-own cigarettes
- Flavored premium cigars: Cigars must be handmade; have a tobacco leaf wrapper; have a wholesale price of no less than $12; not have a filter, tip, or nontobacco mouthpiece; and be capped by hand

Tobacco Use Prevention Program (TUPP)
The Tobacco Use Prevention Program (TUPP) provides support for tobacco free workplaces, schools, and communities. Strategies include, but are not limited to:

Reducing exposure to secondhand smoke, tobacco smoke residue, tobacco waste and other tobacco products;

Reducing the availability of tobacco;

Limiting tobacco promoting influences;

Promoting tobacco cessation resources and referrals to the Kick It California
-
Educating on the California Smoke-free Workplace Laws and El Dorado County Clean Indoor Air and Health Protection Ordinance;
-
Supporting local engagement through community coalitions;

Policy development and enactment.
